Terms of service
These terms govern every wholesale account, quote and order with Prestige Optics Lab, and your use of this website and our customer portal.
Effective date: November 1, 2026
Acceptance of these terms
These terms of service are an agreement between Prestige Optics Lab LLC ("Prestige Optics Lab", "we", "us") and the business that opens an account with us or places an order ("you"). They apply to every quote, sample, stock order, made-to-order or custom order, engraving job and RX order, to your use of our customer portal at my.prestigeopticslab.com, and to your use of this website, prestigeopticslab.com.
You accept these terms when you:
- agree to them in our customer portal, for example when you first sign in, check out, pay through a payment link or save a card; or
- place, confirm or approve an order, or accept a quote, with us in writing, including by email or message.
Browsing this website is covered by Using this website, together with the general provisions and governing law.
If you accept these terms for a business, you confirm you are authorized to bind it. Electronic acceptance and electronic records count as written, signed ones.
These terms take precedence over any conflicting terms in your purchase order or other documents, unless we agree to the conflict in writing. Where documents conflict, the order of precedence applies.
Wholesale accounts
We sell only to trade buyers: opticians, optical stores, eyewear dealers, jewelers, eyewear brands and other businesses that buy for resale or professional use. We do not sell to the public, and we do not examine eyes, write prescriptions or dispense eyewear.
There is no self-registration. You request an account; we review each request, and if we approve it, we open the account and set its pricing. Approval is at our discretion. Before we approve an account or extend payment terms, we may ask for business verification, such as a resale certificate or business license, and we may require a card on file and identity verification.
Accounts are not transferable. Keep your sign-in details confidential: you are responsible for what is done with your account's sign-in, and you must tell us promptly at support@prestigeopticslab.com if you suspect anyone has used it without permission. We may suspend or close an account, including for an overdue balance or a breach of these terms.
Using this website
Nothing on this website is an offer, a quote or a commitment to a lead time. Pricing is confirmed on each order, and we confirm lead times with your order.
Renders are illustrations. Colors shown are approximate. The same goes for 3D views and color swatches: they show a configuration, not a photograph of your order.
Brand and model names appear on this website only to identify what a job is compatible with. They are the trademarks of their respective owners, and no affiliation, sponsorship or endorsement is implied.
Please don't send prescriptions or patient details through this website's forms or messages. We'll arrange how to receive them when we set up RX on your account.
What you send us through this website must be accurate, and yours or your business's to share. We may reply by email or phone, using the details you give us. Our Privacy policy explains how we handle them.
Please don't misuse this website: no scraping or bulk copying, no attempt to break, overload or get around its security, no impersonating anyone, and nothing unlawful.
Our blog is general information, not professional advice. Links to other websites are for convenience, and we are not responsible for their content. We may change, suspend or withdraw any part of this website at any time.
Orders
An order is a request until we accept it. We accept an order when we confirm it in writing, including by email or message, or in our customer portal. Until then, pricing and availability can change, and we may decline an order or fill part of it, including because of a stock shortage, a pricing error or a credit concern.
Stock lenses are held finished and ready to ship. We confirm availability for your shape, colorway and drill when we pick your order. Availability we show you is a guide, not a reservation.
Stock lenses have anti-reflective coating and hard coat as standard, and there is no minimum order on stock lenses.
Check an order's specification before you confirm it: shape, cut, colorway, drill, quantity, logo engraving color and any artwork, and for RX work the prescription and measurements. We fill the order to the specification you confirm.
We confirm lead times with your order. They are estimates, not guarantees.
To cancel an order we have accepted, ask us in writing. If work on it has already been done, we may charge for that work, as we quote it to you when your request reaches us. Made-to-order, custom, engraved and RX items cannot be cancelled once work on them has started.
Pricing and payment
Pricing is set per account, with volume breaks, and custom work is quoted. Prices are in US dollars and exclude taxes, duties and shipping unless your quote or invoice says otherwise. Quoted prices are valid for the period shown on the quote.
Add-ons and RX work are priced on the quote or order. Promotions, such as a launch offer, apply only to orders we accept while they run, and can end at any time.
When payment is due
Payment in full is due before we ship, unless we have approved your account to pay by statement.
Paying by statement
Approval to pay by statement is at our discretion. We ask for identification for the business and for a card kept on file (see Card on file), and we can decline or withdraw the arrangement at any time.
A statement is due within seven (7) days of the due date shown on it. A statement that is not paid by then carries a late charge of ten percent (10%) of the overdue amount, and the same charge is applied again for each further thirty (30) days it stays overdue.
While a balance is overdue we may suspend work, shipping and account access until the account is brought current, and we may close the account and withdraw payment by statement.
You can pay by the methods we offer on your invoice or payment page, or agree with you in writing. A card processing fee may apply; the amount is shown before you pay.
Card on file
If you save a card to your account, or ask us to keep one on file, you authorize Prestige Optics Lab to store it and to charge it for:
- orders you place in our customer portal;
- orders we place for you at your request, including orders you give us by email or message;
- monthly statements, if your account receives them; and
- invoices that are past due.
How charges work
- Each charge is the amount owed at the time: never a fixed amount, and never on a recurring schedule.
- A card processing fee may apply; the amount is shown before you pay.
- Refunds we issue go back to the card that was charged.
How your card is stored
Your card is stored by our payment processor, Stripe, not by us. We never receive or store your full card number; we see only the card's brand and last four digits.
Withdrawing this authorization
You can withdraw this authorization at any time by emailing support@prestigeopticslab.com; this stops future charges, does not cancel amounts already owed, and we may ask for another payment method before further work.
Taxes
Prices exclude sales, use and similar taxes. We add them to your invoice where we are required to collect them.
If you claim a resale or other exemption, give us a valid, completed resale or exemption certificate before we invoice you. If an exemption you claimed is denied, you are responsible for the tax, and for any interest and penalties that come with it.
Shipping
Shipping is charged as shown on your quote, order or invoice.
Orders ship FOB origin: title and risk of loss pass to you when we hand your shipment to the carrier, and the carrier acts as your agent from then on.
Orders are tracked to delivery. Delivery dates are estimates, and we are not liable for delays caused by the carrier, customs, weather or anything else beyond our reasonable control.
If we agree to ship an order outside the United States, you are its importer of record and are responsible for duties, taxes, customs clearance and any other filings.
Shipments that are refused, or returned as undeliverable, come back at your expense.
Returns and exchanges
If something is wrong
Report defects, short shipments and wrong items promptly after delivery, and within any period shown on your invoice, so we can inspect them and replace or credit the affected items. If you don't, the order is accepted as shipped.
Made-to-order, custom, engraved and RX lenses can be returned only for a verified defect or our error. A problem caused by a prescription, measurements or artwork you supplied is not our error.
If you change your mind
We may take back unused stock items in their original condition within the return period shown on your invoice, if we authorize the return in writing before you send them. A returned stock item carries any restocking fee shown on your invoice, and an item we approve for exchange carries any exchange fee shown on your invoice.
Returns for a change of mind are at our discretion: we may decline one when what we delivered matched the order as we accepted it, including its shape, cut, colorway, drill, quantity and engraving. Made-to-order, custom, engraved and RX items are not returnable for a change of mind, and neither is a return from one of your own customers.
The condition we take them back in
An authorized return has to come back as new and unused. We inspect what arrives, and we may decline the refund, or complete the return as a credit instead, if the lenses are no longer in that condition. Lenses that have been scratched, mounted or cut into a frame, or that have lost their original packaging or protective film, are not in that condition.
How to start a return
Email support@prestigeopticslab.com with your order details and the reason. Don't send anything back until we confirm the return in writing. Return shipping is your responsibility; use a tracked service, because we are not responsible for returns lost or damaged in transit.
Made-to-order and custom work
Made-to-order and custom work is quoted, and supplied to the specification you approve in writing.
We may ship a small overrun or underrun within the tolerance stated on your quote, to allow for quality control, and we invoice the quantity actually shipped.
On made-to-order work, anti-reflective coating is an add-on, priced on the quote unless a promotion applies (see Pricing and payment).
Custom artwork is engraved by arrangement. Templates and digital files we create for your work remain ours, unless we assign them to you in a separate written agreement.
For logos and artwork you ask us to engrave, see Logos, trademarks and engraving authorization.
Logos, trademarks and engraving authorization
When you ask us to engrave a logo or artwork, you confirm you own it or have the owner's permission to use it on these lenses.
In this section, a "mark" is any logo, trademark, name, monogram, design, artwork or decoration you ask us to engrave or apply, including one you choose from a list we show for convenience.
- You choose every mark. A list of brands, models or logos on this website or in our customer portal identifies compatibility or is there for convenience. It is not a statement that we are licensed by or affiliated with the owner, or that you may use the mark.
- Your warranty. For each mark on each order, you warrant that you own it, hold the owner's written permission to have it applied to the lenses you order, or are otherwise lawfully entitled to that use, and that the finished lenses will be lawful to sell and use in your channels.
- Proof. On request, you will give us proof of that permission. We may hold, refuse or cancel a job until we have it, or if we believe a use may be unlawful. Work already done is chargeable.
- Our reliance. We rely on your warranty. Accepting a job is not a statement that a use is lawful.
- Your indemnity. You will defend, indemnify and hold harmless Prestige Optics Lab LLC and its members, managers, employees and contractors against any claim, demand, seizure, penalty, settlement, loss or cost, including reasonable attorneys' fees, arising from a mark or artwork you supplied or selected. This includes claims of trademark infringement, counterfeiting, dilution, unfair competition, copyright or design-patent infringement, trade dress and right of publicity. Indemnification also applies.
- Seizures and demands. If goods are seized or detained, or we receive a takedown request, demand or cease-and-desist letter about a mark, we may stop work and cooperate with the authorities or the owner, and you bear the resulting costs.
- Records. We may keep your acceptance of these terms, and any authorization you give for an order, as evidence.
- Survival. This section survives the order and the end of your account.
Prescription (RX) work
RX is arranged directly with us: tell us what you need and we'll set it up on your account. These terms apply to RX work, including our Prestige Vision line, with these additions:
- You are responsible for the prescription and measurements you send us, including their accuracy and validity, pupillary distance and fitting heights; for verifying and inspecting the finished lenses before they are dispensed; and for following the rules that apply to dispensing eyewear where you sell.
- We supply RX lenses to the prescription and measurements we receive. We do not examine eyes or verify prescriptions clinically.
- You confirm you may share the prescription, and any patient details, with us to fill the order, and you send us no more than the order needs.
- Please don't send prescriptions through this website. We'll arrange how to receive them when we set up RX on your account.
- Prescription files attached to an order are deleted automatically, as our Privacy policy describes. After that, a remake needs a new prescription.
- RX items cannot be cancelled once work on them has started, and can be returned only for a verified defect or our error (see Orders and Returns and exchanges).
Regulatory compliance and end use
We supply lenses and engrave them to the specification you give us. The specification, the engraving's content and placement, the marks, and the configuration of the finished product are yours to decide. We do not give regulatory, optometric or design advice.
As between you and us, you are responsible for the eyewear you sell, and for complying with the laws and standards that apply to selling and dispensing optical products in your channels. Where they apply, these include medical-device registration and listing, product standards and any impact-resistance testing required before eyewear is dispensed, marking, packaging and labeling rules, the licensing rules for dispensing opticians and optometrists, and their equivalents in every country where you sell.
Unless our order confirmation says so in writing, we do not represent that a lens meets any particular standard or is suitable for safety or occupational eyewear.
You represent that the finished product, as supplied to your specification, will be lawful for you to sell through your intended channels.
Intellectual property
This website, its renders, 3D views and animations, our catalog and its images, our product designs and our documentation belong to us or our licensors. We license you to use our catalog images and documentation only to market and resell products we supplied to you. Any other use, including for unrelated brands, copies of our designs or third-party sales, needs our written consent.
Our names and logos are our trademarks. Don't use them without our written consent, except to identify products we supplied to you.
You license us to use the artwork, logos and files you send us as needed to quote and fill your orders.
Warranty
We warrant that products we ship will substantially conform to the specification agreed when we accepted the order, and will be free of material defects in workmanship and materials under normal use, for the period stated on your quote or invoice.
This warranty does not cover damage from mishandling, cleaning products or modification after shipment; use outside the product's intended optical application; or a problem caused by a prescription, measurements, artwork or other information you supplied.
If a product does not meet this warranty and you tell us within the warranty period, we will, at our option, replace it, remake it or credit you for it. That is your only remedy under this warranty.
EXCEPT FOR THE LIMITED WARRANTY IN THIS SECTION, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS", AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST CUSTOMERS AND THE COST OF ANY RECALL BY YOU OR YOUR CUSTOMERS, ARISING OUT OF OR RELATED TO PRODUCTS OR SERVICES WE SUPPLY UNDER THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE ORDER THAT GAVE RISE TO IT.
These limits do not reduce your obligation to pay for products and services, or your obligations under Logos, trademarks and engraving authorization and Indemnification.
Indemnification
You will defend, indemnify and hold harmless Prestige Optics Lab LLC and its members, managers, employees and contractors from third-party claims, damages, fines, penalties and reasonable attorneys' fees arising out of:
- your sale, distribution or end use of products we supplied or engraved;
- any mark, artwork or design you supplied or directed us to apply, including the claims described in Logos, trademarks and engraving authorization;
- a prescription, measurements or other information you supplied, or the dispensing of eyewear;
- action by a regulator, licensing board or customs authority arising out of your sale of the products;
- taxes due because an exemption you claimed was invalid; and
- claims by your own customers.
We will tell you promptly about a claim, let you control its defense with counsel we reasonably accept, and cooperate at your expense. You may not settle a claim in a way that admits fault for us or binds us without our written consent.
We will defend, indemnify and hold you harmless from third-party claims arising out of our own gross negligence or willful misconduct in supplying or engraving products for you, subject to Limitation of liability.
Force majeure
Neither party is liable for delay or failure to perform, other than an obligation to pay, caused by events beyond its reasonable control, including acts of God, natural disaster, fire, flood, pandemic, public-health orders, war, civil unrest, terrorism, labor action, equipment failure, power or utility outage, supplier failure, carrier failure, customs holds and government action. The affected party will notify the other promptly and use reasonable efforts to resume performance.
Text messages
We send automated text messages only to a mobile number whose owner has agreed to receive them by ticking a separate box beside it. That box is never ticked for you, and agreeing is not a condition of purchase.
- Program: Prestige Optics Lab text messages.
- What we send: account notifications, such as order and shipping updates and payment reminders, and marketing messages, such as offers and news from us. You agree to the kinds of message the box you tick describes.
- How often: message frequency varies. Message and data rates may apply.
- To stop: reply STOP to any message. We'll confirm, and send no more texts unless you agree again.
- For help: reply HELP to any message, or email support@prestigeopticslab.com.
- Carriers are not liable for delayed or undelivered messages.
How we handle your number and your consent is in our Privacy policy.
General provisions
Changes to these terms. We may update these terms. We post the current version on this page with its version number and effective date. The version in effect when we accept an order governs that order; a later change does not alter an order already accepted.
Order of precedence. If documents conflict, this order applies: a separate written agreement signed by both of us, then our quote or order confirmation, then these terms, then any purchase order or other document you send.
Assignment. Neither party may assign these terms without the other's written consent, except that either party may assign them without consent as part of a merger, acquisition or sale of substantially all of its assets, with notice to the other.
Confidentiality. Each party will keep the other's non-public business information confidential, including quotes, pricing, custom specifications, files and engraving artwork, and use it only to perform under these terms. This survives the end of your account.
Privacy. Our Privacy policy explains how we collect and use personal information.
Notices. We may send you operational notices by email, to the address on your account, or through our customer portal. Legal notices to us must be in writing, sent by email to info@prestigeopticslab.com and by post to the address under Contact.
Independent parties. We are independent contractors. Nothing in these terms creates a partnership, franchise, joint venture, agency or employment relationship, and no one else has rights under them.
Severability. If any provision is held unenforceable, the rest stays in effect, and that provision is reformed to the minimum extent needed to make it enforceable while keeping the parties' intent.
Entire agreement. These terms, together with any quote or order confirmation we issue, are the entire agreement between us on their subject, and replace earlier discussions and proposals.
Waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
Survival. Provisions that by their nature should outlast an order or your account do, including payment, Logos, trademarks and engraving authorization, Warranty, Limitation of liability, Indemnification, confidentiality and Governing law and disputes.
Governing law and disputes
These terms, and any dispute about them or about an order, are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
Any dispute will be brought only in the state courts located in Tarrant County, Texas, or in the United States District Court for the Northern District of Texas, Fort Worth Division, and both parties consent to the jurisdiction of, and venue in, those courts.
